These Terms of Service (“Terms”) govern your use of everybellies.com, our online ordering, catering requests, eClub, and the messaging channels Every-Bellies (“Every-Bellies,” “we,” “us” or “our”) offers, including Google Business Profile messaging. By using them, you agree to these Terms and our Privacy Policy.

1. Using Our Website

You may use our website for personal, non-commercial purposes. Please do not copy or reuse our photos, logos or content without permission, interfere with the site’s operation, or use automated tools to scrape it. Our website is powered by Spillover; Spillover-provided features are also subject to the Spillover Terms of Use (opens in a new tab).

2. Online Ordering

• Online orders and gift cards are placed through Toast, our online ordering partner, and are also subject to Toast’s terms shown at checkout.
• You are responsible for giving accurate contact, pickup and delivery details.
• Menu items, prices and availability may change without notice. Applicable taxes, fees and tips are shown at checkout.
• Pickup and delivery times are estimates and may vary with order volume.
• For pickup orders, please collect your order at 106 Market Street, Tomball, TX 77375 during business hours.
• If something is wrong with your order, call us at (832) 698-4523 and we will work to make it right. Refunds and credits are at our discretion.

3. Delivery

Delivery orders are placed through Toast and may be carried out by a third-party courier. Delivery availability, areas and fees are shown at checkout. We are not responsible for delays or issues caused by third-party couriers, but we will help you resolve any problem with your order.

4. Catering

Submitting a catering request does not confirm an order. A catering order is confirmed only after we contact you to agree on the menu, date, pricing and any deposit. Specific catering terms will be shared at that time.

5. Gift Cards and Promotions

Gift cards are issued and processed through Toast and are subject to the terms shown at purchase. eClub offers, birthday promotions and other discounts are subject to the terms stated in each offer and may be changed or ended at any time.

6. Food Allergies

Our kitchen handles common allergens, and we cannot guarantee any item is allergen-free. Notes in an online order or message are not enough to notify us of an allergy. Please tell a team member directly about any allergy before ordering.

7. Messaging and Communications

You can reach us through Google Business Profile messaging. Some replies may be generated by an AI-powered assistant on our behalf. Those replies are for general information such as hours, menu and location. If an automated reply conflicts with our posted menu, prices or policies, the posted information controls. For order-specific issues, call us at (832) 698-4523.

If you join our eClub, you agree to receive promotional emails and can unsubscribe at any time using the link in any email.

8. Reviews and Content You Share

If you share photos, reviews or comments with us, you confirm you have the right to share them, and you allow us to display them on our website and social media.

9. Disclaimers and Limitation of Liability

Our website and online services are provided “as is” and “as available.” To the fullest extent permitted by law, Every-Bellies is not liable for indirect, incidental or consequential damages arising from your use of our website or online services. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Harris County, Texas.

11. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted here with a new “Last updated” date.
